Ryanair complaints against UK air traffic controllers not upheld

The air traffic control provider was not found to be guilty of failures over airspace capacity, coding and discrimination

Ryanair Holdings plc (LON:RYA) shares fell on Thursday after a case it brought against air traffic controllers was not upheld by aviation authorities.  

The Irish budget airline and Stansted Airport had complained about delays experienced by airlines and passengers due to air traffic flow management.

Following an investigation, codenamed Project Palamon, the UK Civil Aviation Authority (CAA) said air traffic control company NATS En-Route Ltd (NERL) had not been guilty of failures over airspace capacity, coding and discrimination.

The only contravention of NERL’s duties was in “the provision of sufficient staffing resilience” for users of Stansted and Luton airports.

The CAA said it had “taken account of the very difficult circumstances faced by the aviation sector and that air traffic volumes have reduced significantly, following the impact of the Covid-19 pandemic” and noted that “it appears likely it will take some time to reach traffic levels seen in 2018 and 2019”. 

With the circumstances leading to the investigation not currently occurring, it did not feel it was appropriate to take formal enforcement action, but did make a number of recommendations about the provision of a resilient service when demand begins to recover, and in the longer term.

Ryanair shares were down 1% to €12.3 and have fallen 17% since the start of the year.
